of Smart Investment Opportunities and Solemn properties in Tulum. Developer took $254K USD deposit and never completed Solemn Ocean project.

On December 5, 2021 I signed a contract to purchase a pre-construction condo at Solmen Ocean In Tulum.  I wired a $254K payment.  The condo was to be completed by September 29, 2023.  There has been minimal communication from the developer.  The project was never completed and construction never began.

The Solemn Ocean website is still active.

In March, 2023 I received the following email:

At Smart Investment Opportunities we are grateful for the trust you have put on us, this is why we would like to share with you the next notice to inform you the current status of SOLEMN Ocean.

The purpose of this notice is to keep you updated, also, if you would like us to give you more detailed information, please let us know so we can contact you by WhatsApp, phonecall or email. We are attaching our numbers at the end of the notice. 

 

At the beginning of the excavation in the land for SOLEMN Ocean our engineering team detected water on the underground. This discovery doesn’t stop us from doing the construction of the development, but we see ourselves in the need of making some modifications which we are explaining here:

 

• The first change has to do with the structure of the complex will now be made out of steel, this modification is helping us accelerate the construction for at least 3 months. The new steel structure will be arriving in the next days. 

• The next change is on the parking lot, due to the water found on the underground the parking lot will know be a semi-underground parking lot. This will help the complex gain height, at least, 2 meters, and will give us a better ocean view. As a result of this change, Tulum’s government asked us for a new permission (which is soon to be given to us) to continue with the construction. 

• Lastly, we see ourselves in the need of using the 90 days of grace that we have per contract, so now the date of delivery will be from the endings of September to the endings of December 2023. In case we have to take more time the developer confirmed us that there will be a compensation once the time of delivery finishes.
